Corps of Engineers issues Enbridge Energy permit for regulated activities proposed for the Line 5 Tunnel project, releases Record of Decision
Enbridge’s project involves construction of a tunnel underneath approximately four miles of lakebed to house a replacement segment of the Line 5 pipeline. The Detroit District affirmed that issuance of a USACE permit for the Enbridge Line 5 tunnel's construction complies with all applicable federal laws and regulations. Through its review, USACE fulfilled its responsibilities under the National Environmental Policy Act, Section 404 of the Clean Water Act, Section 10 of the Rivers and Harbors Act of 1899, Section 7 of the Endangered Species Act, Section 106 of the National Historic Preservation Act, and federal Tribal trust responsibilities. While the USACE permit authorizes Enbridge to work within waters regulated by the federal government, USACE does not regulate the design or operation of the pipeline itself, or any substances transported within it.
